Terms of Sale

The owner of the online store stabilika.ee (hereinafter referred to as the Online Store) is Stabilika OÜ, located at Kajaka tn 29a, Tallinn 13418, Harju County.

Validity of the Sales Agreement, Product and Price Information
The terms of sale apply when purchasing goods from the Online Store.
The prices of products sold in the Online Store are listed next to the products.
A delivery fee is added to the price. The delivery fee depends on the buyer’s location and the delivery method chosen.
The delivery fee is displayed to the buyer when placing the order.
Product information is provided next to the product in the Online Store, and the prices in the e-shop are listed in euros.

Placing an Order
To order products, the desired items must be added to the shopping cart. To complete the order, the required fields must be filled in, and a suitable delivery method for the products must be selected. The total amount will then be displayed on the screen, which can be paid via a bank link or another payment solution. The bank links are processed by Montonio Finance OÜ in the Online Store.
The following bank links are available for payment in the Online Store: Swedbank, SEB, Luminor, LHV, Coop Pank.
The agreement becomes valid when the payment is received in the Online Store’s settlement account.
If the ordered product cannot be delivered due to the product being out of stock or for any other reason, the buyer will be notified as soon as possible, and the paid amount (including the delivery fee) will be refunded immediately, but no later than 14 days from the notification.

Delivery
Goods are delivered within Estonia to Itella SmartPost parcel lockers.
The buyer bears the shipping costs, and the corresponding price information is displayed next to the shipping method.
Domestic shipments in Estonia will generally arrive at the buyer’s designated destination within 2–3 working days from the conclusion of the sales agreement. Delivery outside of Estonia will take 14–28 calendar days.
In exceptional cases, the right to deliver the goods within up to 45 calendar days is reserved.

Right of Withdrawal
After receiving the order, the buyer has the right to withdraw from the agreement concluded in the online store within 14 days. The right of withdrawal does not apply if the buyer is a legal entity.
To exercise the 14-day right of withdrawal, the goods must not be used in any way other than to verify their nature, characteristics, and functioning, as permitted for testing the product in a physical store.
If the product has been used for any purpose other than to verify its nature, characteristics, and functioning, or shows signs of use or wear, the Online Store has the right to reduce the refund according to the decrease in the product’s value.
To return the product, the buyer must provide a document confirming the purchase (invoice, receipt, bank statement) and send it to the email address info@miravitale.eu no later than 14 days from the receipt of the product.
The return shipping costs are borne by the buyer, except when the return is due to the item not matching the order (e.g., incorrect or defective item).
The buyer must return the product within 14 days of submitting the withdrawal request or provide evidence that the product was handed over to the carrier within the aforementioned period.
The Online Store will refund the amounts paid by the buyer for the returned products without delay, but no later than 14 days after receiving the withdrawal notice.
The Online Store may refuse to make a refund until it has received the item or until the buyer provides proof that the item has been returned, whichever occurs first.
If the buyer explicitly selects a delivery method different from the cheapest standard delivery option offered by the Online Store, the Online Store is not obligated to refund the cost that exceeds the usual delivery method’s cost.
The Online Store has the right to cancel the sales transaction and request the return of the product if the product price in the Online Store was significantly lower than the market price due to a mistake.

Right to File a Claim
The Online Store is responsible for any non-conformity or defect of the product sold to the buyer that existed at the time of delivery and becomes apparent within two years of delivery. During the first six months from the delivery, it is presumed that the defect existed at the time of delivery. It is the Online Store’s responsibility to disprove this assumption.
The buyer has the right to contact the Online Store regarding defects no later than two months after noticing the defect, by sending an email to info@stabika.ee.
The Online Store is not responsible for defects that arise after the product is delivered to the buyer.
If a product purchased from the Online Store has defects for which the Online Store is responsible, the Online Store will repair or replace the defective product. If the product cannot be repaired or replaced, the Online Store will refund all fees related to the sales agreement to the buyer.
The Online Store will respond to the consumer’s complaint in writing or in a format that allows reproduction within 15 days.

Direct Marketing and Personal Data Processing
The Online Store uses the personal data entered by the buyer (e.g., name, phone number, address, email address, bank details) solely for processing the order and sending the goods to the buyer.
The Online Store will forward personal data to transport service providers to deliver the goods.
The Online Store will send newsletters and offers to the buyer’s email address only if the buyer has expressed interest by providing their email address on the website and consenting to receive direct marketing notifications.
The buyer can unsubscribe from receiving emails with offers and newsletters at any time by notifying the Online Store via email or following the instructions provided in the email.
The Online Store is the data controller and will forward necessary personal data for payment processing to the authorized processor Montonio Finance OÜ.

Dispute Resolution
If the buyer has complaints about the Online Store, they should be sent via email to info@stabilika.ee.
If the buyer and the Online Store cannot resolve the dispute through negotiation, the buyer may contact the Consumer Disputes Committee. The committee has jurisdiction over disputes arising from agreements between the buyer and the Online Store. Reviewing the complaint in the committee is free of charge.
